1. General

Document sets forth the terms and conditions ("Terms and Conditions") governing your use of our website www.vivavolt.com (“Website”), our applications (“Application” or “Apps”) or any products or services in connection with the Application/, Website/products (“Services”) or (b) any modes of registrations or usage of products.

For the purpose of these Terms and Conditions, along with any amendments to the same, and wherever the context so requires “You”, “Your” or “User” refer to the person visiting, accessing, brow text-startsing through and/or using the Website/Application or using the Services or Products, at any point in time. The term “We”, “Us”, “Our” shall mean and refer to the Website and/or the Company, depending on the context. The headings of each section in this Agreement are only for the purpose of organising the various provisions under this Agreement in an orderly manner. These headings shall not be used by either party to interpret the provisions contained under them in any manner.

Please read these Terms and Conditions, along with the Privacy Policy and all other rules and policies made available or published on Viva Volt as they shall govern your use of the Viva Volt. By using or visiting the Viva Volt or any Viva Volt software, data feeds, and service provided to you on, from, or through the Viva Volt, you signify your agreement to (1) these “Terms and Conditions”, (2) Privacy Policy and any other terms that are updated from time to time. If you do not agree to any of these terms, please do not use the Viva Volt.

2. Registration

To use the services provided on the website and make purchases, it is compulsory to create an account. A User may create an account on the Website which shall collect only User’s basic information. To create an account, you need to choose a username and password (in some cases school will assign the username and password). You must keep your account and registration details current and correct for communications related to your purchases from the Website. You agree and confirm that you will never use another User’s account nor provide access to your account to any third-party. When creating your account, you confirm that the information so provided is accurate and complete. Further, you agree that you are solely responsible for the activities that occur on your account, and you shall keep your account password secure and not share the same with anyone. You must notify Viva Volt immediately of any breach of security or unauthorized use of your account.

At the time of registration, the Company shall collect the following personally identifiable information about you: Name - including first and last name, email address, mobile phone number and other contact details, demographic profile (like your age, gender, address, etc.,). Information collected about you is subject to the Privacy Policy of the Company, which may be read as part and parcel of these Terms of Use.

You are solely responsible for protecting the confidentiality of your username and password and any activity under the account will be deemed to have been done by you. In the event you provide us with false/inaccurate details or the Company has a reasonable ground to believe that false and inaccurate information has been furnished, we hold the right to permanently suspend your account.

3. Subscription/Membership

The Website/Application is an online platform where user can gain access to materials that help them prepare for subjects that are offered through the platform. The User can register themselves online and then gain access to the video lessons, animation, interactive content, exercises, games, worksheets, assignments, or any other material or content in any electronic format (“Study Material”) after purchasing the subscription from Viva Volt/obtaining the subscription via school. The Study Materials shall be unlocked based on the amount paid for such Study Material. The Users shall make a yearly subscription for the Study Material from the platform.

Membership to the Viva Volt is absolutely required to avail certain services and functionalities provided therein. Membership of the Viva Volt is strictly private and is governed by the Legal documents and such other terms and conditions as the Company may specify from time to time. The Company shall sell its product at a specific price. The free print books included in the Volt course packages, wherever applicable, will be delivered in India only.

The offer of free print books with subscription is at the discretion of Viva Volt and availability of stocks. The delivery will be done within select areas only.

The user understands and confirms that the classes subscribed to can be upgraded and/or downgraded only as permitted by the VOLT platform. This can vary from time-to-time and is depended on the courses and curriculum delivery options available and applicable at the time of Upgrading and/or downgrading. Viva Online Learning Technologies reserves the right to upgrade/downgrade or not to upgrade/downgrade any user and shall have the right to the final decision in this matter.

The user agrees that the Volt platform is meant to be used in conjunction with the school curriculum. The user agrees that the school administration can cancel/suspend/disable the user's access and/or account at its discretion if the user has associated himself/herself to a that is an institutional subscriber to Volt. Granting of registration to a User is within absolute and sole discretion of Viva Volt and no User shall claim the same as a matter of right. Further, mere registration does not guarantee membership unless and until the same has been approved and confirmed by Viva Volt or its management through a message communication.

5. Security

Transactions on the Website are secure and protected. Any information entered by the User when transacting on the Website is encrypted to protect the User against unintentional disclosure to third parties. The User’s credit and debit card information is not received, stored by or retained by the Company / Website in any manner. This information is supplied by the User directly to the relevant payment gateway which is authorized to handle the information provided, and is compliant with the regulations and requirements of various banks and institutions and payment franchisees that it is associated with.

6. Communications

By using this Website, it is deemed that you have consented to receiving calls, auto dialed and/or pre-recorded message calls, e-mails, from Us at any time with the use of the telephone number and e-mail address that has been provided by you for the use of this website which are subject to the Privacy Policy. The user agrees to receive promotional communication and news letters from the Company and its partners.

This includes contacting you through information received through other parties. The use of this website is also your consent to receive SMSes from Company at any time we deem fit. This consent to be contacted is for purposes that include and are not limited to clarification calls and marketing and promotional calls. The user can opt out from such communication and/or newsletters either by unsubscribing on the Website itself, or by contacting the customer services team and placing a request for unsubscribing by sending an email to (add email).

The sharing of the information provided by you will be governed by the Privacy Policy and We will not give out such contact information of yours to third parties not connected with the Website.

7. Pricing

All the prices are inclusive of GST. Please refer to individual Course Packages for pricing details. Shipping and handling charges, wherever applicable, are included in the course prices.

8. Payment

The following payment options are available on the Website or Application:

  1. Domestic and international credit cards issued by banks and financial institutions that are part of the Visa, Master Card & Amex Card networks
  2. Visa & Master Card Debit cards
  3. Netbanking/Direct Debit payments from select banks in India. A list of available options will be made available at the time of the Purchase.

  5. UPI
  6. As prescribed by the financial institutions issuing the credit or debit cards affiliated with Visa / Master Card / Amex, the User will be required to submit his/her 16-digit card number, card expiry date and 3-digit CVV number (usually on the reverse of the card) while making an online transaction. The User must also have enrolled his/her card with VBV (Verified by Visa), MSC (MasterCard Secure Code) or any other applicable provider in order to complete the transaction. The User is hereby expressly made aware that his/her card statements will reflect that a payment has been made in favour of the Company. The User is further aware that in case of third party statements, including bank and credit card statements, the merchant name may appear in an abbreviated format, and the Company has no control over the same. To successfully subscribe on the Website, the User is required to complete the transaction by making the payment for the services opted for.

9. User Obligations

  1. You are bound not to cut, copy, distribute, modify, recreate, reverse engineer, distribute, disseminate post, publish or create derivative works from, transfer, or sell any information or software obtained from the website. With our prior permission limited use may be allowed. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Website is not permitted.
  2. You agree not to access (or attempt to access) the Website and/or the materials or Services by any means other than through the interface that is provided by the website. The usage of the Website/Application/Services is not endorsed as a substitution to the curriculum based education provided by the educational institutions but is intended to supplement the same by explaining and presenting the concepts in a manner enabling easy understanding. The basic definitions and formulae of the subject matter would remain the same. The Company acknowledges that there are various means of delivering structured curriculum pedagogy and inclusion of methods in the Website/Application/Services does not imply endorsement of any particular method nor exclusion imply disapproval. Subscription to the our Website/Application/Services does not in any manner guarantee admission to any educational institutions or passing of any exams or achievement of any specified percentage of marks in any examinations.

Viva Volt also disclaims all liability with respect to the misuse, loss, modification or unavailability of any user content.

The user understands and agrees that any material or data downloaded or otherwise obtained through the website is done entirely at his/her own discretion and risk and he/she will be solely responsible for any damage to his/her computer systems or loss of data that results from the download of such material or data. We are not responsible for any typographical error leading to an invalid coupon. Viva Volt accepts no liability for any errors or omissions, with respect to any information provided to you whether on behalf of itself or third parties.

12. Indemnification and Limitation of Liability

You agree to indemnify, defend and hold harmless this website/company including but not limited to its affiliate vendors, agents and employees from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by us that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms and Conditions. 13. Termination

This User Agreement is effective unless and until terminated by either you or the Company. You may terminate this User Agreement at any time, provided that you discontinue any further use of the Website. The Company may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site.

Such termination will be without any liability to the Company. The Company’s right to any Comment sand to be indemnified pursuant to the terms hereof, shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for product(s) already ordered from the Site or affect any liability that may have arisen under the User Agreement prior to the date of termination.

15. Disputes and Jurisdiction

All disputes involving but not limited to rights conferred, compensation, refunds, and other claims will be resolved through a two-step Alternate Dispute Resolution mechanism..

  1. Stage 1: Mediation. In case of a dispute, the matter will first be attempted to be resolved by a sole mediator who is a neutral third party and will be selected at the mutual acceptance of a proposed mediator by both parties. Both parties may raise a name for the sole mediator and in the case both parties accept the proposed name, the said person shall be appointed as sole mediator. In case the parties are not able to reach a consensus within two proposed mediators, the Company reserves the right to decide who the final mediator is. The decision of the mediator is not binding on both parties.
  2. Stage 1: Arbitration. In case that mediation does not yield a result suitable or preferred by any one of the parties, arbitration may follow, the award of which is binding on both parties. The Arbitration Board shall comprise three members – one appointed by each party and the third member to be nominated by the two appointed members by mutual consent. Arbitration shall be held at Mumbai, India. The proceedings of arbitration shall be in the English language. The arbitrator’s award shall be final and binding on the Parties. If the dispute cannot be resolved by this two-step Alternate Dispute Resolution mechanism, it shall be referred to the courts at Mumbai. If the dispute cannot be resolved by this two-step Alternate Dispute Resolution mechanism, it shall be referred to the courts at Delhi.

16. Privacy

We encourage you to read the Privacy Policy and to use the information it contains to make informed decisions regarding Your personal information. Please also note that certain information, statements, data and content (such as but not limited to photographs) which You provide on the Website are likely to reveal Your gender, ethnic origin, nationality, age, and/or other personal information about You. You acknowledge and agree that your submission of such information is voluntary on Your part. Further, You acknowledge, consent and agree that we may access, preserve, and disclose information You provide to Us at any stage during Your use of the Website.
